JUST EAT EXTRA COURIER LOYALTY PROGRAMME TERMS & CONDITIONS (UK)
1. Introduction and Overview
- These Terms and Conditions ("Loyalty Terms") govern the Just Eat Extra Courier Loyalty Programme ("Extra" or the "Programme") provided by Just Eat.
- By participating in Extra, or using any perks or discounts unlocked through the Programme, you agree to be bound by these Loyalty Terms in addition to your existing Just Eat Courier Agreement ("Courier Agreement").
- Extra is designed to reward active couriers based on quality metrics and delivery consistency. The Programme is currently being rolled out on a city-by-city basis. Just Eat does not guarantee that Extra will be available in your delivery zone at all times.
2. Relationship of the Parties
- No Employment Relationship: Participation in Extra, the earning of any levels, or the unlocking of perks does not alter your legal status under the Courier Agreement. You remain a self-employed independent contractor.
- No Obligation to Work: Extra provides incentives for consistent service quality but does not impose any obligation on you to accept or complete delivery opportunities. You retain full freedom to choose when, where, and how often you log into the Courier App, or whether you utilise the perks unlocked.
- Delivery Service Quality: Perks such as "Preferential Scheduling" or "Preferential Assignment" are service quality indicators intended to enhance commercial workflow efficiency.
3. Eligibility and Automatic Enrollment
- All active couriers with an un-suspended, valid Just Eat account in participating launch zones are automatically enrolled in Extra.
- While enrollment is automatic, utilisation of the benefits is entirely optional. If you do not carry out any deliveries or choose not to use your perks, your tier will still be calculated and displayed in the Courier App.
4. The Tiers
- Tiers: Extra features three levels: Bronze, Silver, and Gold. New couriers or couriers returning from inactivity default to the Bronze level.
- The Quality Metrics: Levels depend on four distinct pillars tracked through the app:
- Delivered Orders:
- The total volume of completed, successfully handed-over orders.
- On-time Pickup Rate:
- The percentage of times you arrived at the restaurant or grocery partner within the designated window.
- On-time Delivery Rate:
- The percentage of deliveries completed within the promised customer time frame.
- Completion Rate:
- The percentage of accepted delivery offers that you successfully fulfilled.
- The Evaluation Period: Levels are evaluated dynamically and locked on the 1st day of every calendar month. Evaluation is based entirely on your delivery activity and Quality Metrics from the preceding calendar month.
- Monthly Lock-In: Once calculated on the 1st of the month, your tier remains locked for that entire calendar month. However, extreme drops in service quality or material violations of your Courier Agreement (including safety policy breaches) may result in an immediate tier downgrade or an account review.
- Cancellations & Disputes:
- Customer-initiated and Support-initiated cancellations (e.g., restaurant closures) will not negatively impact your Completion Rate.
- Self-unassigning from an order will negatively impact your Completion Rate, unless the wait time at the restaurant has exceeded the platform's specified wait threshold.
- Any technical platform errors affecting metrics must be reported to Courier Support within 48 hours of the delivery for potential adjustments.
5. Third-Party Perks and the Rewards Marketplace (Onsi Partnership)
- Role of Just Eat: Certain benefits, including fuel discounts, insurance options, and marketplace savings, are curated and facilitated via third-party providers such as Onsi (the "Suppliers"). Just Eat's role is strictly limited to facilitating access to these platforms based on your qualifying tier.
- Supplier Terms Apply: All third-party deals, insurance products, or discounts are subject to the respective Supplier's own terms of business and availability. Just Eat cannot guarantee that any specific fuel discount percentage or partner deal will remain permanently available.
- Disclaimer of Liability for Third-Party Products: Because Just Eat does not provide the underlying products or third-party services (such as fuel, vehicle maintenance, or insurance policies), Just Eat is not responsible for the quality, safety, availability, or suitability of items purchased through the Onsi network or other partners. Any product defects or disputes must be handled directly with the third-party merchant.
- Personal Use Only: All perks, vouchers, and webshop discounts unlocked through Extra are strictly for your personal use as a courier. You are legally prohibited from selling, copying, reproducing, or trading vouchers. Fraudulent use of perks will result in immediate removal from the Programme and potential termination of your Courier Agreement.
6. Platform Perks & Execution Mechanics
- Preferential Scheduling & Run Creation:
- Gold: Entitles you to create delivery runs dynamically at your convenience.
- Silver: Unlocks priority views of available runs up to 24 hours before Bronze couriers.
- 6.1.1. Run availability remains subject to fluctuating localised customer demand. Just Eat does not guarantee Run minimums.
- Preferential Assignment: High-tier couriers receive algorithmic priority for delivery offers when multiple couriers are available in an immediate zone. This mechanism optimises system efficiency and does not guarantee fixed earnings or order volumes.
- Fast Cash: Fast Cash allows couriers to request instant payment transfers of completed earnings. Fees for using Fast Cash are applied or discounted relative to your locked monthly tier (e.g., standard fee for Bronze, 50% discount for Silver, and 100% waiver for Gold).
- Courier Webshop Discounts: Voucher codes or automated checkout discounts for courier kit (jackets, bags) and accessories are tied to your level status. Discretionary kit replacement policies apply, and discounts cannot be combined with separate store promotions unless stated otherwise.
7. Modifications, Suspension, and Termination
- Just Eat reserves the right to modify, amend, suspend, or terminate the Extra Programme, its tier structure, target metrics, or associated perks at any time, in whole or in part, by giving reasonable notice via email or the Courier App.
- If your Courier Agreement is suspended or terminated for any reason, your access to Extra and all unredeemed perks or locked tiers will instantly expire.
8. Limitation of Liability
- To the maximum extent permitted by law, Just Eat shall not be liable for any indirect or consequential losses, loss of business opportunities, or loss of anticipated earnings arising out of your participation in Extra or any technical app malfunctions that temporarily distort tier listings.
9. Governing Law and Jurisdiction
- Governing Law & Jurisdiction: These Loyalty Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
10. Miscellaneous Terms
- Severability: If any provision or part-provision of these Loyalty Terms is or becomes invalid, illegal, or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these Loyalty Terms.
- Entire Agreement: These Loyalty Terms, alongside your Courier Agreement, constitute the entire agreement between you and Just Eat regarding the Extra Programme and supersede all previous agreements, promises, assurances, warranties, representations, and understandings between us, whether written or oral, relating to its subject matter.
- Waiver: No failure or delay by Just Eat to exercise any right or remedy provided under these Loyalty Terms or by law shall constitute a waiver of that or any other right or remedy.
- Third Party Rights: Unless expressly stated otherwise, these Loyalty Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
